#PBCHOOPS received this post concerning the new AKTIVATE system for student athletic packets being used by the Palm Beach County School District.
This is not original content and presumably was posted on another website or forum. However the concerns are legitimate and we felt is something that should be broadly shared with the #PBCHOOPS community:
ATTN: Moms dads grandparents whoever has a child who plans to participate in public school sports/activities in the household!!! Long post but PLEASE READ.
Let me start by saying I am not a lawyer but I know red flags when I see them. I know I cannot be the only one who isn't comfortable with this. Over the past few days I have been receiving emails from my children's schools requiring us to fill out a new athletic packet on this new website Aktivate in order for our children to participate in school sports and activities this year. I happily went to the site fill out the appropriate forms but upon creating an account before you can submit there are two boxes one which states you agree to the terms in conditions. Upon clicking the box it starts to list all of the different things you need to agree to including agreeing to share your personal information and student data with third party sites, Aktivates corporate affiliates and subsidiaries. It does not list who they are. It also basically says once a third party site has your information they are not responsible for what happens to it. There are so many other things that are concerning but most of all I do not like being backed into a corner. In the age of information when we are teaching our children to be careful what information we allow online I just do not feel comfortable with putting my child's private medical information and other data out there in another platform to be used for god knows what. Data breaches happen ALL THE TIME . From what I understand it's AGREE or your child can't play. I know that we share data daily and I understand that my child's information is already in whatever medical portal my doctors office uses BUT that doesn't mean I should just be ok with every single "corporate affiliated company" or whoever to have that information as well. Please check out the terms of use and the privacy policy and let me know what you think. I am not saying there is something nefarious going on but I simply do not like that we as parents are without any other option but to agree to their terms or our kids can't play. Companies collect and share data all the time and just because it states they aren't "selling the data" does not mean they aren't sharing that data and being compensated in some other way. Again not saying that's 100% what's happening but you just hear about this sort of thing all the time. Maybe if there is anyone who deals with law in this group that could shed some light on this I'd really appreciate but I just feel like I can't be the only one who feels this way. What do you think? Are you ok with just forking over all you child's medical information to third party sites?
Also side note: HIPPA law cannot protect you if you agree to have the Information shared.
Additionally it states if the company ever goes under and gets sold all the information goes with it. Then what? They're no longer bound by the agreement.
